These Terms of Service govern your access to and use of coastaebike.com, any related online services operated under the COASTA brand, and any purchase made through the website.

Throughout these Terms, “COASTA,” “we,” “us,” and “our” refer to the operator of coastaebike.com. “You” and “your” refer to any visitor, account holder, purchaser, recipient, or user of a COASTA product.

By accessing the website, creating an account, placing an order, or using a product or service obtained through the website, you agree to these Terms and to the policies incorporated by reference.

· Any product-specific, promotion-specific, financing, preorder, or order terms displayed before purchase

If a specific written term conflicts with these Terms, the more specific term controls for the relevant transaction, subject always to applicable mandatory law.

2. Eligibility and authority

You must have legal capacity to enter into a binding contract in your jurisdiction.

If you are under the age of majority, a parent or legal guardian must review and approve the purchase and must supervise use where required by law.

If you place an order on behalf of a company, organization, or another person, you represent that you have authority to bind that party.

3. Safe and lawful product use

Electric bicycles and electric dirt bikes are powered vehicles capable of causing serious injury, death, or property damage if assembled, maintained, charged, or operated incorrectly.

Before use, the rider must:

· Read and follow the user manual and all warnings supplied with the product

· Complete any required assembly, setup, and pre-ride inspection

· Check the frame, wheels, tires, brakes, fasteners, battery, controls, lights, and electrical connections

· Wear a properly fitted helmet and other protective equipment appropriate to the product and terrain

· Follow all stated rider, cargo, speed, terrain, age, and operating limits

· Stop riding immediately if a safety fault, unusual noise, overheating, braking issue, structural concern, or electrical problem appears

· Comply with all local laws concerning motor power, speed, throttle use, registration, licensing, insurance, age, helmets, public-road use, trail use, and permitted riding areas

Product classifications differ by location. A product or operating mode that is permitted on private property or off-road terrain may not be lawful on public roads, bicycle lanes, sidewalks, or trails.

You are responsible for determining whether the product and each operating mode may lawfully be used in your location.

4. Website information and performance estimates

COASTA aims to provide accurate product descriptions, photographs, prices, specifications, dimensions, compatibility information, inventory status, and estimated performance information.

However:

· Product colors may appear differently because of screen settings, lighting, photography, or production variation

· Product specifications, supplied components, packaging, and software may change as products are improved or supply conditions change

· Dimensions and weight may vary within reasonable manufacturing tolerances

· Product photographs may show optional accessories or equipment not included in the base purchase

· Range, speed, acceleration, charging time, hill-climbing ability, and other performance figures depend on test conditions, rider weight, cargo, terrain, elevation, temperature, wind, tire pressure, riding style, selected mode, battery age, maintenance, and other variables

· Typographical, pricing, technical, translation, or inventory errors may occur

Performance figures are estimates or results obtained under stated conditions. They are not a guarantee that every rider will achieve the same result.

COASTA may correct an error, update information, or cancel an order affected by a material pricing, specification, or inventory error. If a paid order is cancelled, the amount collected for the cancelled item will be refunded.

5. Products, components, and availability

Products, colors, configurations, accessories, replacement parts, and services may be offered in limited quantities, in selected locations, or for a limited period.

COASTA may update, replace, restrict, or discontinue a product, component, color, feature, accessory, or service without creating an obligation to modify products already sold.

A feature shown on one model does not necessarily apply to another model.

COASTA does not guarantee that every replacement part, accessory, firmware version, or configuration will remain available indefinitely.

6. Prices, taxes, duties, and promotions

Prices are displayed in the currency shown on the website and may change before an order is accepted.

The customer is responsible for applicable sales tax, value-added tax, customs duty, import charge, environmental fee, delivery surcharge, and other government or carrier charge unless the website expressly states that the charge is included.

Promotions may be subject to separate eligibility, timing, quantity, geographic, product, and combination rules. Promotional codes, free gifts, rebates, and discounts have no cash value unless expressly stated.

COASTA may correct or cancel a promotion affected by an obvious error, fraud, abuse, or technical malfunction.

7. Orders and acceptance

Submitting an order is an offer to purchase. An automated order confirmation acknowledges receipt of the order but does not necessarily mean that the order has been accepted.

COASTA may decline, limit, place on hold, or cancel an order for reasons including:

· Product or inventory unavailability

· Pricing, description, or technical error

· Payment authorization failure

· Inability to verify purchaser, payment, or delivery information

· Suspected fraud, resale abuse, policy abuse, or unauthorized activity

· Shipping, legal, regulatory, or geographic restriction

· Quantity limit

· Safety concern

· Events outside COASTA’s reasonable control

If COASTA cancels an order after payment has been collected, COASTA will refund the amount collected for the cancelled item.

8. Payment

You must provide current, complete, and accurate billing, shipping, contact, and payment information.

Payments may be processed by third-party payment, financing, fraud-prevention, or installment providers. Their eligibility decisions, terms, privacy notices, and processing rules may apply.

COASTA does not guarantee that a particular card, financing, installment, wallet, or accelerated-checkout option will be available to every customer or order.

You authorize COASTA and its payment providers to charge the total amount disclosed at checkout, including applicable product price, shipping, tax, and other disclosed charges.

9. Electronic communications

By using the website or placing an order, you consent to receive transactional communications electronically, including order confirmations, payment notices, shipping updates, policy notices, safety information, warranty communications, and customer-service messages.

Marketing communications are subject to separate consent and opt-out rights.

You are responsible for keeping your email address and other contact information current.

10. Shipping and delivery

Order-processing and delivery dates are estimates unless COASTA expressly states that a date is guaranteed.

Delays may result from carrier operations, weather, customs, holidays, inventory, address problems, access limitations, safety events, government action, or other circumstances outside COASTA’s reasonable control.

You must provide an accurate and deliverable address and cooperate with reasonable carrier requirements.

If COASTA cannot ship within a legally required or specifically promised period, COASTA will provide any notice, consent option, cancellation right, or refund required by applicable law.

Delivery, risk of loss, and title are determined by the checkout terms, carrier record, and applicable law.

You must inspect the shipment promptly and report loss, visible damage, concealed damage, or missing items in accordance with the Shipping Policy and Return & Refund Policy.

11. Address changes, refused delivery, and undeliverable orders

Address changes are not guaranteed after an order is placed.

Do not refuse delivery unless COASTA has instructed you to do so in writing.

Where permitted by law, carrier fees, storage fees, return freight, redelivery costs, or other documented charges caused by an incorrect address, failed delivery, unauthorized refusal, or customer-requested redirection may be charged to the customer or deducted from a refund.

12. Returns, refunds, cancellations, and exchanges

Returns, refunds, cancellations, and exchanges are governed by the COASTA Return & Refund Policy.

A product must not be returned without written authorization and return instructions.

Sending a product to an unauthorized address, returning it cash-on-delivery, or refusing delivery without authorization does not guarantee a refund.

13. Limited warranty

Eligible products are covered only as stated in the COASTA Limited Warranty.

The limited warranty does not replace or reduce mandatory rights that apply under consumer law.

Warranty service may require proof of purchase, product identification, photographs, video, diagnostic information, or return of the affected component.

Do not incur repair, labor, towing, transport, storage, or diagnostic charges expecting reimbursement unless COASTA has approved the work in writing.

14. Accounts and account security

You are responsible for maintaining the confidentiality of account credentials and for activity conducted through your account.

You must notify COASTA promptly if you suspect unauthorized access, account misuse, or a security breach.

COASTA may suspend or restrict an account where reasonably necessary to protect customers, the website, payment systems, or the business from fraud, abuse, or security risk.

15. Reviews, photographs, videos, and other submissions

If you submit a review, photograph, video, suggestion, comment, or other content, you confirm that:

· You have the right to submit it

· It is accurate and lawful

· A review represented as a customer review reflects genuine experience

· It does not infringe another person’s intellectual-property, privacy, publicity, or other rights

· It is not defamatory, deceptive, threatening, obscene, or discriminatory

· It does not contain malicious code, confidential information, or unauthorized personal information

You grant COASTA a non-exclusive, worldwide, royalty-free license to reproduce, edit for length or format, translate, publish, display, distribute, and use the submitted content for website, customer-service, advertising, and promotional purposes.

COASTA may remove or decline to publish content that violates these Terms, but is not required to publish every submission.

16. Intellectual property

The website and its content, including trademarks, logos, product names, text, photographs, product images, videos, graphics, software, layout, and design, are owned by or licensed to COASTA and are protected by applicable intellectual-property laws.

Access to the website does not transfer ownership or grant a commercial license.

Except as permitted by law, you may not reproduce, scrape, republish, distribute, sell, reverse engineer, modify, or commercially exploit website content without prior written permission.

17. Third-party services and links

The website may use or link to payment providers, financing providers, review platforms, social media, videos, maps, analytics tools, advertising services, shipping providers, or other third-party services.

COASTA does not control and is not responsible for a third party’s availability, security, content, eligibility decision, product, service, privacy practice, or terms.

Your use of a third-party service is governed by that provider’s terms.

18. Prohibited conduct

You may not use the website, an account, or a COASTA service to:

· Violate any law or another person’s rights

· Commit fraud or submit a knowingly false claim

· Misrepresent identity, authority, product ownership, or product condition

· Interfere with website, payment, or security systems

· Introduce malware, malicious code, or automated attacks

· Collect personal information without authority

· Circumvent geographic, quantity, pricing, eligibility, or security restrictions

· Scrape or copy website content for unauthorized commercial use

· Abuse returns, warranties, promotions, financing, referrals, rewards, chargebacks, or payment disputes

· Resell products in violation of written restrictions

· Use the website or a product for an unlawful or unsafe purpose

19. Suspension or termination

COASTA may suspend or terminate access to the website or an account where a user materially violates these Terms, creates a legal or security risk, engages in fraud, or repeatedly abuses a policy.

Termination does not affect rights, payment obligations, warranty obligations, or liabilities that arose before termination.

20. Disclaimer

The website is provided on an “as available” basis.

To the maximum extent permitted by law, COASTA does not guarantee that the website will always be uninterrupted, error-free, secure, or compatible with every device or browser.

Product warranties are provided only through the COASTA Limited Warranty and any mandatory consumer law.

Nothing in these Terms excludes a warranty, guarantee, duty, or remedy that cannot legally be excluded.

21. Limitation of liability

To the maximum extent permitted by law, COASTA and its officers, employees, contractors, suppliers, and service providers are not liable for indirect, incidental, special, exemplary, punitive, or consequential loss, including loss of use, income, data, business, opportunity, or substitute transportation.

Where liability cannot be excluded, it is limited only to the extent permitted by applicable law.

Nothing in these Terms limits liability for fraud, willful misconduct, death or personal injury caused by negligence where such liability cannot be limited, or any other liability that law does not permit COASTA to exclude.

22. Indemnity

To the extent permitted by law, you agree to indemnify COASTA against third-party claims and reasonable costs arising from:

· Your unlawful use of the website

· Your material breach of these Terms

· Your violation of another person’s rights

· Your unauthorized and unsafe modification or misuse of a product

· A knowingly false or fraudulent claim

This provision does not apply to the extent that the claim was caused by COASTA’s own unlawful conduct or negligence.

23. Events outside reasonable control

COASTA is not responsible for a delay or failure caused by an event outside its reasonable control, including natural disaster, severe weather, fire, epidemic, war, civil disturbance, government action, customs delay, labor disruption, carrier interruption, utility failure, cyberattack, or supply-chain interruption.

This section does not remove a cancellation, refund, or other right provided by mandatory law.

24. Applicable law and consumer rights

These Terms are subject to the laws and mandatory consumer-protection requirements applicable to the relevant transaction.

Nothing in these Terms excludes or limits a consumer right, guarantee, remedy, or protection that cannot legally be excluded or limited.

25. Severability

If a provision of these Terms is found unlawful or unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will continue in effect.

26. No waiver

A delay or failure to enforce a provision does not waive the right to enforce that provision or another provision later.

27. Assignment

You may not assign or transfer your rights or obligations under these Terms without COASTA’s written consent.

COASTA may assign its rights and obligations in connection with a reorganization, transfer of business, change of legal entity, merger, financing, or sale of assets, provided that any mandatory consumer rights remain protected.

28. Entire agreement and order of priority

These Terms, together with the policies and transaction-specific terms incorporated by reference, form the agreement relating to the website and purchase.

If terms conflict, the following order applies:

1. Mandatory law

2. Written order-specific terms

3. Written promotion-specific or preorder-specific terms

4. These Terms and the incorporated policies

29. Changes to these Terms

COASTA may update these Terms to reflect changes in law, products, technology, services, or business operations.

The current version will be posted on this page with a revised effective date.

A change will not retroactively reduce a right that has already accrued unless permitted by law.
